Lawsuit

Questions have been raised as to whether a lawsuit could be brought against Central Vermont Medical Center (CVMC) to stop the closure of the clinic here.

Generally speaking, parties are entitled to equitable relief (an injunction) provided that there is no legal remedy available. The relationship that the Mad River Valley Health Center, Inc. (MRVHC) has with CVMC is contractual in nature (i.e., landlord and tenant) and MRVHC would be entitled to monetary damages in light of a breach of that contract (lease). MRVHC has no cause of action or right to require CVMC to remain here as a tenant. In the event that CVMC vacates the premises prior to the expiration of its lease the only recourse that MRVHC has is to seek monetary damages for the balance of any rent that remains due.
